1. Definitions
For the purposes of these Terms and Conditions:
- "We", "Us", "Our" refers to Masa Kirana, operating at No. 8, Lebuh Armenian, 10200 George Town, Pulau Pinang, Malaysia.
- "Service" refers to the watch repair and related services we provide, as described on this website.
- "Customer", "You", "Your" refers to any person who contacts us, submits an enquiry through our website, or brings a watch to our workshop.
- "Website" refers to the site at masakira.blog.
- "Agreement" refers to these Terms and Conditions together with any service confirmation we provide.
2. Acceptance of Terms
By using our website or submitting an enquiry, you confirm that you are at least 18 years of age and have the legal capacity to enter into a binding agreement. If you are acting on behalf of another person, you confirm that you have authority to do so.
Use of our website or services constitutes acceptance of these Terms. If you do not agree, please do not use our website or services.
3. Services
Masa Kirana provides three watch repair services from our workshop in George Town:
- Heritage Movement Care (RM 238) — full mechanical movement service
- Dial & Hand Refresh (RM 285) — cosmetic and visual restoration
- Strap, Case & Comfort Fitting (RM 328) — wearability and exterior service
Services are carried out at our George Town workshop. We do not offer postal or courier-based repair. All watches must be brought to and collected from the workshop in person, or by an authorised representative.
We reserve the right to decline any repair request where we do not consider ourselves suitably equipped to carry out the work safely or satisfactorily.
4. Customer Responsibilities
When leaving a watch in our care, you confirm that:
- You are the lawful owner of the watch, or have authority from the owner to arrange its repair
- Any information you provide about the watch (its history, previous repairs, known issues) is accurate to the best of your knowledge
- You will collect the watch within 30 days of receiving notice that it is ready. Watches left uncollected after 60 days may be subject to a storage fee
- You will not misuse our website, submit false information, or attempt to gain access to our systems without authorisation
5. Intellectual Property
All content on this website — including text, images, layout, and design — is the property of Masa Kirana or its licensors. You may view and print pages for personal, non-commercial use. You may not reproduce, distribute, or use content for commercial purposes without our prior written consent.
6. Payment Terms
All prices are shown in Malaysian Ringgit (RM) and are inclusive of applicable taxes. Payment is due upon collection of the watch. We accept cash and common electronic payment methods. We do not require a deposit in advance of service unless specifically agreed.
If the watch requires additional work beyond the agreed service scope, we will contact you before proceeding. You will not be charged for work you have not approved.
Cancellation and refunds
If you wish to cancel a repair before work has begun, please contact us and we will return the watch to you at no charge. If work has already commenced, a partial charge for work completed may apply. We will discuss this with you before returning the piece.
We do not offer refunds for completed services where the work was carried out as agreed. If you have a concern about the quality of a service, please contact us directly so we can discuss a resolution.
7. Service Delivery Terms
Turnaround times given at the time of drop-off are estimates and not contractual commitments. Timeframes may vary depending on the condition of the watch and workshop workload. We will contact you if a significant delay arises.
We take reasonable care of all watches in our possession. Each piece is individually stored and labelled. However, watches are left with us at the owner's risk. We recommend that customers with high-value pieces ensure they carry appropriate insurance cover.
We will not proceed with any work beyond the agreed service without your explicit approval.
8. Disclaimers
Our services are provided with reasonable skill and care. However, watchmaking carries inherent uncertainty, particularly with vintage and aged movements. We cannot predict every issue that may arise during servicing, and some watches present complications that are only discoverable once opened.
We make no representation that any specific rate accuracy, power reserve, or other performance outcome will be achieved following a service. We will share realistic expectations based on the watch's condition at the time of assessment.
Our website is provided on an "as is" basis. We do not warrant that the site will be uninterrupted or error-free.
9. Limitation of Liability
To the fullest extent permitted by Malaysian law, Masa Kirana's liability in connection with any claim arising from our services shall not exceed the amount paid for the service in question.
We are not liable for indirect, consequential, or incidental losses arising from use of our services or website, including loss of enjoyment of a watch, sentimental loss, or commercial losses.
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, or for fraudulent misrepresentation.
10. Indemnification
You agree to indemnify and hold harmless Masa Kirana, its staff, and representatives from any claims, losses, or damages arising from your breach of these Terms or from your misrepresentation of ownership or authority over a watch left with us.
11. Termination
Either party may end a service arrangement before work begins without penalty. Once work has commenced, the provisions of Section 6 (cancellation and refunds) apply. These Terms continue to apply to any obligations arising before termination.
12. Dispute Resolution
These Terms are governed by the laws of Malaysia. In the event of a dispute, we encourage you to contact us directly at [email protected] so that we can attempt to resolve the matter informally.
If an informal resolution is not possible, disputes shall be subject to the jurisdiction of the courts of Malaysia. Consumer rights under the Consumer Protection Act 1999 (Malaysia) are not affected by these Terms.
13. General Provisions
- Entire Agreement: These Terms, together with any service confirmation we provide, constitute the full agreement between us regarding the services.
- Severability: If any provision is found unenforceable, the remaining provisions continue in full effect.
- Waiver: Our failure to enforce any provision on one occasion does not constitute a waiver of that provision in future.
- Assignment: You may not assign your rights under these Terms without our written consent. We may transfer our rights and obligations to a successor entity.
14. Changes to These Terms
We may update these Terms from time to time. Changes become effective upon publication on this page. We encourage you to review this page periodically. Continued use of our services after changes constitutes acceptance of the revised Terms.
